Terms of use

You are requesting to use the sandbox environment of CAIWE API (the “Sandbox”) via this developer portal. This Sandbox makes available, only for testing purposes, applications used for account information services, payment initiation services as defined under local legislation implementing EU Payments Services Directive 2 and its underlying regulatory technical standards (PSD2). CAIWE does not process any actual end user data in its Sandbox, but only dummy data.

 

You are entitled to use the Sandbox in accordance the terms of use ('Terms of Use') stated below.

  

The use of the Sandbox and its functionality is free. But some additional functionality may also be charged at a later stage. By registering as a user of CAIWE Sandbox, you acknowledge and agree that:

 

  • You provide accurate and reliable data and information,
  • You use the Sandbox, the services, its content and information in good faith, with all due care and by using suitable updated computer security solution. You are responsible for protecting your IT systems, data and other material from viruses, malware, and any security risks.
  • You have a legal basis for processing personal data. You agree to comply with any local provisions and requirements relating to such processing,
  • You are either a registered as Account Information Service Providers (AISP) or Payment Initiation Service Providers (PISP) of any member state of the European Union and you have the authorization from the CSSF to operate on the Luxembourg territory; or you have submitted your application file to your Competent authority in a member state of the European Union and, upon request, you are able to present a written confirmation of the submission.
  • Registration details are personal and shall not be assigned. You will keep your registration details secret from others and you shall not make commercial use of your Sandbox access identifiers. Where applicable, you confirm you are legally authorized to bind your company,
  • You have assessed the risks incurred by the use of the Sandbox. You accept without restriction all risks associated and accept that CAIWE shall never be held liable in this respect,
  • Not to use CAIWE name, logo, trademarks, copyrights, intellectual / business / know-how property;
  • You shall prevent inappropriate conduct such as false, inappropriate or illegal statements, and you undertakes not using the Sandbox for promotional content,
  • You will provide CAIWE, at its first request, any additional information that may be necessary for operational or security purposes,
  • You may terminate the use of the Sandbox at any time, without having to give any reason whatsoever, but after providing CAIWE,
  • In case of breach of this Term of Use, CAIWE is entitled to block your access to the Sandbox.

 Please note these Terms of Use will not be applicable to the use of the future CAIWE API. The Sandbox (its information, services and functionalities) is intended to change going forward. The current use of the Sandbox does not constitute a binding commitment with regard to the future. Services, technical functionalities are not guaranteed. For use in a real production environment, other conditions might exist. Sometimes the service may not be fully available, because of maintenance or modification on the portal.

 

Nothing in these Terms of Use will be construed as creating a partnership, agency, employment or joint venture relationship of any kind between the parties. You shall not have the authority to bind CAIWE, act on its behalf or create a liability against it.

CAIWE may process personal data in the context of the use of the Sandbox. It shall only collect data that is useful or required for the purpose of managing this use. The process of personal data is made in compliance with CAIWE personal data protection policy. This policy is available via the Bank’s website (http://www.ca-indosuez.com) by selecting the “Your Personal Data” section on the Luxembourg website.

 

These Terms of Use or the use of CAIWE Sandbox are governed by Luxembourg law. Any disputes in relation to these Terms of Use shall be submitted to the exclusive jurisdiction of the Courts in Luxembourg.
